These terms apply when you use the Fÿl Hydrate website at drinkfyl.com (and the editorial site at review.drinkfyl.com) or join our waitlist. By using either site or submitting your email address to us, you agree to these terms. If you don't agree, please don't use the site.
We've kept these as plain as we reasonably can.
About Fÿl
Fÿl Hydrate is a pre-launch consumer brand based in Branchburg, New Jersey, United States. The sites you're using are currently informational and used to collect interest from potential customers. We are not yet selling products through this site. When we begin selling, these terms will be updated to reflect that.
The waitlist
By submitting your email to our waitlist, you're telling us you'd like to hear from us when our product launches. Joining the waitlist:
- Does not obligate you to purchase anything
- Does not guarantee availability of any specific product, price, or quantity
- Does not create any contract for sale or supply between you and Fÿl
We may communicate the terms of the founders list — including pricing, batch limits, and timing — through emails sent to waitlist members. Those terms will be specified clearly at the time of any pre-order or sale and will govern that transaction.
Founders list and limited batches
References on this site to "founders pricing," "first 500," "Box #001 through #500," or similar describe our intent at the time of launch. Final terms — including pricing, allocation, ship dates, and product specifications — will be communicated to waitlist members in advance of any pre-order opportunity. Joining the waitlist does not reserve a numbered box or guarantee any specific spot in any batch.
Email communications
When you join our waitlist, we'll send you emails about Fÿl. You can unsubscribe at any time by clicking the link at the bottom of any email we send. If you unsubscribe, you'll stop receiving our marketing emails but may still receive transactional messages (for example, if you've made a purchase).
Acceptable use
You agree not to:
- Use our sites for any unlawful purpose
- Submit false or misleading information (including using someone else's email address without permission)
- Attempt to access parts of the site that aren't intended for public use
- Interfere with the operation of the site, including by attempting to overwhelm it with traffic, deploying malware, or scraping content
- Reproduce, copy, or republish substantial portions of the site's content without permission
Intellectual property
All content on the Fÿl sites — including the brand name, logo, written copy, photography, illustrations, and design — is owned by Fÿl Hydrate or used with permission. You may share links to our pages and quote brief excerpts with attribution, but you may not reproduce, modify, or republish our content for commercial use without written permission.
Editorial content and reviews
The site at review.drinkfyl.com is editorial content published by Fÿl Hydrate. While written in editorial voice, it is not an independent third-party review — it is created and published by us. Any opinions or claims expressed are our own. References to product benefits reflect intended product positioning at the time of writing.
No medical claims
Fÿl Hydrate is intended to be a beverage. Nothing on our sites is medical advice, and no statement should be interpreted as a claim that our product diagnoses, treats, cures, or prevents any disease or condition. If you have a medical condition or are taking medication, consult your healthcare provider before changing your diet or hydration routine.
Disclaimers
Our sites are provided "as is." We try to keep the information accurate and the site working, but we don't guarantee that everything will be error-free, complete, or available without interruption.
To the fullest extent permitted by law, Fÿl Hydrate disclaims all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent permitted by law, Fÿl Hydrate will not be liable for any indirect, incidental, consequential, or special damages arising out of your use of our sites — including loss of profits, loss of data, or business interruption — even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these terms or your use of our sites will not exceed one hundred US dollars (US $100).
Changes to these terms
We may update these terms from time to time. When we do, we'll change the "last updated" date at the top of the page. Continued use of the site after changes are posted constitutes acceptance of the new terms. Significant changes will also be communicated by email to subscribers.
Governing law
These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of laws principles. Any dispute arising from these terms or your use of our sites will be resolved in the state or federal courts located in Somerset County, New Jersey.
